Welcome to DefaultKawaii! The terms "we", "us" and "our" refer to DefaultKawaii. DefaultKawaii operates this store and website, including all related information, content, features, tools, products and services to provide you with a curated shopping experience (the "Services"). DefaultKawaii is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [insert link]. If you do not agree, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms, you represent that you are at least 18 years old (or the age of majority in your jurisdiction), and you have given us consent for any minor dependents to use the Services on devices you own or manage.

To use the Services, you may need to provide accurate information (e.g., email, billing, payment, shipping details). You warrant that all information you provide is correct, current and complete. You are responsible for maintaining account security and all activity on your account. You may not transfer or share your account.

SECTION 2 - OUR PRODUCTS We aim for accurate representations of our products (digital downloads like coloring PDFs/PNGs, sticker sheets, tarot packs; and physical A4 coloring books). However, colors/appearance may vary due to your device/settings.

Product descriptions may change without notice. We may discontinue or limit products/quantities at our discretion.

SECTION 3 - ORDERS Placing an order is an offer; we may accept or decline it. Your order is accepted (and contract formed) when we confirm it (e.g., via email) and process payment. Review orders carefully—changes/cancellations may not be possible after acceptance.

You warrant purchases are for personal/household use (not resale/export unless commercial license purchased).

SECTION 4 - PRICES AND BILLING Prices are in AUD, exclude taxes/shipping/customs unless stated. Prices may change; the price at order placement applies.

You must provide accurate payment info and update it promptly. You warrant your payment method is valid and charges will be honored.

SECTION 5 - SHIPPING AND DELIVERY (Physical Products Only) For physical items (e.g., A4 coloring books), delivery times are estimates. We are not liable for delays by carriers, customs, or events beyond our control. Risk/title passes to you upon handover to the carrier.

Digital products are delivered instantly via download/email—no shipping applies.

SECTION 6 - INTELLECTUAL PROPERTY All content (art, designs, trademarks, logos, etc.) is owned by DefaultKawaii or licensors, protected by Australian and international IP laws.

These Terms allow personal, non-commercial use only. You may not reproduce, modify, distribute, or use our content commercially without written consent (except under any commercial license you purchase). Unauthorized use may violate IP laws. All rights reserved.

SECTION 7 - OPTIONAL TOOLS Third-party tools (e.g., integrations) are "as is"—we provide no warranties and have no liability for your use.

SECTION 8 - THIRD-PARTY LINKS Links to third-party sites are at your risk—we're not responsible for their content or practices.

SECTION 9 - RELATIONSHIP WITH SHOPIFY Sales are directly with DefaultKawaii. Shopify is not liable for transactions, products, or issues between you and us.

SECTION 10 - PRIVACY POLICY Your personal information is handled per our Privacy Policy [link] and Shopify's Privacy Policy. By using the Services, you consent to this.

SECTION 11 - FEEDBACK Any feedback you submit grants us a perpetual, royalty-free license to use it. You warrant you own rights to it and it complies with these Terms.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS We may correct errors/omissions in pricing, descriptions, etc., including after order submission.

SECTION 13 - PROHIBITED USES Use Services lawfully only. Prohibited: unlawful acts, IP infringement, harassment, spam, viruses, scraping, etc. We may suspend/terminate access for violations.

SECTION 14 - AGENTS (keep if relevant, or remove if not using AI agents).

SECTION 15 - TERMINATION We may terminate access anytime. Certain sections survive termination.

SECTION 16 - DISCLAIMER OF WARRANTIES Services/products "as is." No warranties beyond ACL guarantees. (Add note: "Nothing in these Terms excludes rights under Australian Consumer Law.")

SECTION 17 - LIMITATION OF LIABILITY To extent permitted by law (including ACL), we are not liable for indirect/consequential damages, etc.

SECTION 18 - INDEMNIFICATION You indemnify us for breaches of these Terms or law violations.

SECTION 19–25 — Keep as-is (severability, waiver, entire agreement, assignment, governing law, changes, contact).

Key additions/edits for ACL/digital compliance:

• In disclaimers/liability: Add "Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot be lawfully excluded."
• Refund Policy link: Create a separate page stating: "For digital downloads: No change-of-mind refunds (as per ACL, digital products are generally non-returnable once downloaded). Faulty items remedied by re-supply or refund. Physical items: Change-of-mind returns within 30 days if unopened/unused, plus ACL remedies."
• Governing law: Change to "These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of Queensland courts."
